Know Your Rights!

Countless smokers have found themselves in the position of dealing with the police while having marijuana or smoking accessories in their possession. Here are a few tips to make sure you utilize your rights and don’t get into trouble for no reason. For even more information check out the NORML website at norml.org.

ON FOOT

  • You don’t have to answer any questions and have the constitutional right to remain silent. The only exception is that in some states you are required to give an officer your name.
  • If you are on foot when an officer stops you, don’t consent to a search. Instead, calmly ask, “Am I free to go?” If they say you are not free to go, you are being detained. If the police have “reasonable suspicion” they can pat down the outside of your clothing only. A key item here: Do not run!

IN THE CAR

  • You must provide your name, license, registration and proof of insurance.
  • Police officers cannot search your car without consent unless they have “probably cause”. Be careful here because often an officer has been trained to make their questions sound more like an order. If you don’t know your rights, it’s easy to be misled and find you’ve agreed to something you didn’t mean to. Remember that you have the right to remain silent and to not answer questions without your attorney present.

IN YOUR HOME

  • Law enforcement can only search your home if they have your consent or a warrant. Be sure to let your roommates know that if they give consent to the officer(s) and allow them to enter your home, they are legally allowed to search the entire house.
